Messaging & SMS Terms

SMS programs are subject to carrier rules, the TCPA, CTIA messaging principles, and A2P 10DLC registration requirements. These Messaging & SMS Terms describe the text-message programs operated by [LEGAL ENTITY] for CheckPlease (the "messaging program"). They supplement our Terms of Service and Privacy Policy. By providing your mobile number and opting in, you agree to these terms.

1. Program description

CheckPlease may send the following kinds of text messages:

TCPA / consent flag. Transactional OTP and user-initiated invites have a different consent posture than promotional/marketing texts. Do not send marketing messages without prior express written consent, and never condition use of the app on agreeing to receive marketing. Sending invitations to a friend's number that the friend did not provide can create TCPA exposure — counsel should review the invite flow.

You opt in by providing your mobile number and taking an affirmative action — for example, requesting a sign-in code, or enabling/sending an invite — through the app or website. The opt-in screen will identify the program, link to these terms and our Privacy Policy, and state that message and data rates may apply. Your consent is not a condition of any purchase. We do not sell or share your mobile number with third parties for their own marketing.

3. Message frequency

Message frequency varies based on your activity (for example, how often you sign in or send/receive invites). OTP messages are sent only when you request a code.

4. Message & data rates

Message and data rates may apply according to your mobile plan and carrier. We do not charge you for the messages themselves, but your carrier may. Contact your carrier for details about your plan.

5. Opt-out (STOP) & help (HELP)

You are in control of the messages you receive:

STOPReply STOP to any message to unsubscribe. You will receive one final confirmation, and we will stop sending program messages to that number. (Stopping OTP texts may prevent phone-based sign-in.)
HELPReply HELP for help, or contact us at [privacy@phonesdown.net].
STARTIf you previously opted out, reply START (or opt in again in the app) to resume messages.

You can also disable in-app and push notifications in your device settings at any time.

6. Carriers & delivery

Supported carriers may include major and regional U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier and device availability, and we cannot guarantee that every message will be delivered or delivered on time.

7. Privacy

Your mobile number and how we handle it are described in our Privacy Policy. Mobile information is used to operate the messaging program and is shared only with the service providers that help us send messages (such as our SMS/authentication provider). We do not sell mobile numbers, and we do not share them with third parties or affiliates for their own marketing or promotional purposes.

8. Eligibility

You must be the account holder or authorized user of the mobile number you provide, and you must meet the minimum age in our Terms of Service. Do not provide a number that is not yours.

9. Changes

We may update these Messaging & SMS Terms from time to time. We will update the "Last updated" date above, and material changes to an active program will be communicated as required by applicable rules.
